One question that occurs to me is whether the definition of “securities industry/customer disputes” should be broadened to include the investment advisory industry and its participants.  In an unfortunate trend that I predicted in a paper that I presented at the 2006 California mid-year-meeting, there has been an enormous upsurge in the number of and the total assets under management by persons registered and marketing themselves as investment advisers.  The damage they can inflict on their clients is on par with the damage that the securities industry and its participants can do. 

 

One thing seems clear:  if a lawyer or law firm is defending investment advisers and their firms against customer/client claims, that lawyer or law firm should not be on the PIABA list-serve.
